最开始，这只是一个“简单”的专业股票推荐电话，但是投资人却被拉进了虚拟币的深渊。这场以“比特币”设赌的局，让入局者深陷其中，脱身无门。当数十万的资金不翼而飞时，才惊醒悔悟。

2019年11月初，刘洋接到这样一通陌生来电，通过该电话号码，刘洋进入了“G21［昌鸿私募］交流群”。进群后的一段时间，群内会通过文字直播的形式讲解股票相关知识，同时也推荐一些股票。后来，群里有人反映文字直播形式学习效果不好，希望能开视频直播，老师就开了视频直播。
At the beginning of November 2019, Liu Yang received such a strange call, and through this number he entered the “G21 [Chang Hung's Private] Exchange Group.” During the period of the group's visit, stock-related knowledge was presented and some stocks were recommended. Later, some people in the group reflected the poor performance of the text-based form of learning, hoping that the video would be live, and the teacher would open the video.
记者尝试打开视频直播地址，输入网址后，提示：“要访问的网站被大量用户举报，存在虚假信息，网站通过虚假的信息诱骗您进行交易，或诱骗您的电话号码、身份证号码等个人信息，已为您拦截。”
Journalists try to open a live video address and enter it into the web site, reminding them: “The site to be visited is reported by a large number of users, there is false information, and the site has intercepted you by enticing you to make a transaction through false information, or by enticing you with personal information such as your phone number, identity card number, etc.”.
开通视频直播后，刘洋跟着老师通过视频直播学习。在视频直播一段时间后，老师说他们要推出他们的私募股票：昌鸿一号计划和昌鸿二号计划，保底收益30%，叫群里的投资者准备好资金，待合适的进场时机进场购买。
When the video was launched, Liu Yang followed the teacher to learn via video live. 刘洋各买了一部分，但基本都处于亏损状态，群里部分股友质疑，该私募计划股是不是骗人的？虽然直播间老师一直在解释，但是股票并没有起色。

2019年12月4日，晚间直播过程中，老师表示要通过别的方式带大家把股票的亏损赚回来。接着，老师在直播里展示比特币行情操作，并称：“时间短、收益高。”当天晚上助手就把比特币客服人员拉入微信群，说想赚回亏损的股友可以添加客服的微信询问比特币行情软件注册开户相关事宜。

刘洋添加了比特币客服微信，并下载了手机版行情软件，同时注册开通了账户。如果可以重来，刘洋一定不会添加这个微信号，也不会在这个软件里进行比特币买卖操作。

数十万元“不翼而飞”
在下载手机版行情软件并进行注册认证后，刘洋在软件里通过手机银行向指定的账户充值人民币，然后按照即时汇率折算成美元到该手机版行情软件的个人账户。

2019年12月5日，刘洋充值第一笔14220元人民币到账户里。接下来一周，老师都在直播时间带着刘洋等投资人进行操作。

在此期间盈利不大，但确实是盈利的。老师一直在怂恿刘洋等人持续充值足够的资金，并表示资金越多赚的收益就会越多。同时，还要求每人截图充值的资金量，不充值就不带着操作。

转折发生在2019年12月22日，这天早上，助理发信息给刘洋说今天行情好，老师会加播带单操作，并且特别叮嘱为了不泄露操作指令，让刘洋退出之前加的微信群。

当天中午13：00老师开播，13：40下指令让刘洋等人买涨，接下来的半个小时略有下跌且行情一直在震荡，老师随后表示直播已经一个多小时了，要先退出直播，他会在群里发操作指令。

暴跌后，刘洋立即联系助理跟她说明情况，助理把刘洋的情况反映给老师后，老师表示要帮刘洋填补账户负值。暴跌当日下午六点左右，刘洋账户的余额从负值变成零。

2019年12月23日，老师继续直播，对22日的行情暴跌只字不提，并且把刘洋踢出群聊。

2019年12月27日，助理给刘洋发微信称，第二天老师会带着继续操作虚拟币，叫他去充值，刘洋因没有资金所以没充值，这次也是刘洋最后一次联系上助理。

刘洋表示，2019年12月29日至今，刘洋数次发信息给助理、老师、比特币客服等人，均没有回复。

在与刘洋的交谈中，记者了解到，上述老师称自己所属公司为昌鸿阳关私募基金管理有限责任公司。记者通过国家企业信用信息公示系统，并没有找到该公司信息。记者通过中国证券投资基金业协会私募基金管理人综合查询系统检索“昌鸿阳关私募基金管理有限责任公司”，也没有找到相关信息。
In an interview with Liu Yang, the journalist learned that the above-mentioned teacher claimed that his company was running a limited liability company on behalf of Chang Hong Yang's private fund. The journalist did not find information on the company through the National Corporate Credit Information System.
此外，据刘洋所述，其使用的名为THOMAS的比特币交易软件已经无法登陆，官网也打不开了。

记者注意到，刘阳所使用的比特币行情软件可以人为控制客户账户虚拟币的数量，进行“加仓、减仓”操作。

数字货币行业资深从业人员对《每日经济新闻》记者表示：中心化的软件，都有被人为操控的可能性。代码写出来的世界，有bug很正常，被人为控制也很正常，小的交易软件分分钟都有可能跑路。
Senior practitioners in the digital money industry say to Daily Economic News journalists that centralized software has the potential to be manipulated. The world of code-written bugs is normal, controlled, and small trading software is likely to run every minute.
那么，上述事件中的操作合法吗？老师、助理、比特币客服人员的突然失联又存在哪些法律风险？投资者的损失还能追回吗？
So, is the operation legal in the above-mentioned events? What are the legal risks associated with the sudden loss of association of teachers, assistants, and personnel serving in Bitcoin? Can investors’ losses be recovered?
带着上述疑问，记者采访了数字货币行业资深律师。该律师对记者表示：我们首先需要了解虚拟币的性质。依据我国《民法总则》，网络虚拟财产是受法律保护的，而目前法律法规对比特币等虚拟货币之属性还没有明确规范。此前中国人民银行发布的《关于防范比特币风险的通知》否定“虚拟货币”作为货币的法律地位，但并未对其作为商品的财产属性予以否认。对此，结合司法实践关于肯定比特币的虚拟财产地位的案例。我认为，将虚拟币定义为虚拟财产更为适当。虚拟币交易软件账户中的虚拟币属于投资者所有。故虚拟币交易软件工作人员操纵投资者账户里的虚拟币数量，其行为本质侵害到投资者的财产权益。

The lawyer said to the journalist that we need to first understand the nature of the virtual currency. According to our General Civil Code, virtual property on the Internet is protected by law, while the properties of virtual currency, such as the relative currency, are not clearly regulated by current laws and regulations.
上述律师表示：如果投资者的虚拟货币是被工作人员设计清空的，因为虚拟货币目前的法律定位为虚拟财产，该工作人员的行为实质就侵犯了他人财产权益，可能涉嫌的罪名包括盗窃罪、诈骗罪、集资诈骗罪等。
The above counsel states that if the investor's virtual currency is emptied by the staff member, since the virtual currency is currently legally located as virtual property, the staff member's conduct violates the property rights and interests of others in substance and may be suspected of crimes such as theft, fraud, capital fraud, etc.
遇到该类情况，投资者还需尽快采取私力救济措施，包括尝试与投资软件开发者取得联系，积极协商等。必要时可以提起诉讼。如工作人员已失联，投资数额较大，涉嫌盗窃或诈骗的，投资者可以选择报警，投资者的损失是否能够追回还需更多的当事人信息以及案件调查材料。
In such cases, investors also have to resort to private remedies as soon as possible, including attempting to contact investment software developers and actively consulting.
