請您在認真閱讀並充分理解《協議》內容之後決定是否接受本《協議》。如您是未成年人（未滿18周歲），須在法定監護人陪同下閱讀並決定是否接受本《協議》。您接受本《協議》全部內容之後，即可註冊、登錄或使用本《協議》所涉相關服務。您的註冊、登錄、使用等行為視為對本《協議》全部內容的接受。
If you are a minor (under 18 years of age), you must read and decide whether or not to accept the Agreement, accompanied by a legal guardian. If you accept all the provisions of the Agreement, you can register, register or use the services associated with the Agreement.
本《協議》是您（下稱“用戶”）與螢火蟲之間關於註冊、登錄“螢火蟲”視頻直播平臺以及使用“螢火蟲”視頻直播平臺服務所訂立的協議，本《協議》約定了螢火蟲與用戶之間關於“螢火蟲”服務方面的權利義務。
This Agreement is a protocol between you (hereinafter referred to as “user”) and fireflies for registration, recording the Fireflies live video platform and using Fireflies live video studio service, which sets out the rights of fireflies and users with respect to fireflies services.
“用戶”是指註冊、登錄、使用、瀏覽、獲取本《協議》項下服務的個人或組織。
“User” means a person or organization that registers, registers, uses, views, receives services under this Agreement.
本《協議》內容由螢火蟲隨時更新，用戶可在本網站查閱最新版協議條款。更新後的協議條款壹旦公布即代替原來的協議條款。協議條款更新後，如您不同意接受，您不應繼續使用螢火蟲提供的服務。
The agreement is updated by fireflies at any time. Users can check the latest version of the agreement on their website.
1、用戶充分理解並同意：螢火蟲僅為用戶提供信息存儲、分享平臺服務，用戶必須為自己註冊帳號下發生壹切行為負責，包括因您所傳送至螢火蟲平臺的任何內容、信息等所導致的不利後果，該等不利後果包括但不限於賠償、罰款、司法/仲裁程序費用、律師費、合理支出、給螢火蟲造成的損害等。用戶應對螢火蟲平臺上其他註冊用戶（包括主播）發布的內容自行加以判斷，並承擔因使用該內容而給自己、他人及社會造成的法律責任，包括但不限於因對內容的準確性、真實性、完整性或實用性等的依賴而產生的風險。
1. Users fully understand and agree that fireflies only provide users with information storage and share counter services. Users must be responsible for all actions that occur under their registry accounts, including the adverse consequences of any content, information, etc. that you transmit to fireflies platforms, including but not limited to compensation, penalties, costs of judicial/arbitral proceedings, lawyers’ fees, reasonable expenses, damage to fireflies. Users should decide for themselves on content released by other fireflies platforms, including anchors, and assume legal responsibility for the use of the content for themselves, others and society, including but not limited to risks arising from reliance on accuracy, authenticity, integrity or practicality of the content.
2、用戶在使用螢火蟲服務中發布的任何內容、信息等並不反映或代表螢火蟲的觀點、立場或政策，螢火蟲對此不承擔任何責任。
2. The fireflies do not bear any responsibility for any content, information, etc. issued by users using fireflies services that do not reflect or represent the fireflies'views, positions or policies.
3、用戶充分理解並同意：螢火蟲是壹個基於用戶關系網的點對點信息服務平臺，用戶須對在螢火蟲上的註冊信息的真實性、合法性、有效性承擔全部責任，用戶不得冒充他人或利用他人的名義傳播任何信息，不得惡意使用註冊帳號導致其他用戶誤認。否則，螢火蟲有權立即停止提供服務，註銷用戶的螢火蟲帳號，用戶應自行承擔由此而產生的壹切法律責任。
3. Users fully understand and agree that fireflies are a point-to-point information service platform based on user networks, that users must assume full responsibility for the authenticity, legitimacy, validity of registered information on fireflies, that users should not pretend to be or use the names of others to disseminate any information, and that the use of a registered account should not lead to misperception by other users. Alternatively, fireflies have the right to stop providing services immediately, that fireflies account for users, and that users should assume their own legal responsibility for the resulting fireflies account.
4、螢火蟲對用戶上傳的所有信息的真實性、合法性、無害性、有效性等不負任何單獨或連帶之保證責任，用戶因其所傳播的信息而引發的相關法律責任由用戶自行承擔。
4. Fireflies have no sole or collateral responsibility for the authenticity, legitimacy, ineffectiveness, validity, etc. of all information uploaded by users, and the related legal responsibility of users for the information transmitted by them rests with the users themselves.
5、用戶充分理解並同意：因業務發展需要、突發情勢等，螢火蟲可能會臨時變更，暫停、限制或者終止螢火蟲部分或全部服務，螢火蟲將努力但不保證能做到事先通知。用戶知悉並願意承擔該類風險。
5. Users fully understand and agree that fireflies may change over time due to business needs, sudden-onset situations, etc., to suspend, restrict, or terminate some or all of their services, but the fireflies will try not to provide advance notice. Users know and are willing to take on such risks.
6、用戶充分理解並同意：螢火蟲提供的服務中可能包括廣告。用戶同意在使用服務過程中顯示螢火蟲和第三方供應商、合作夥伴提供的廣告。同時，螢火蟲有權在直播間內添加網站logo（或名稱）和時間的水印標誌。螢火蟲將盡力但不保證不影響您的直播體驗。
6. Users fully understand and agree that the service provided by fireflies may include advertisements. Users agree to display messages provided by fireflies and third-party suppliers and partners during their use.
7、用戶不得利用螢火蟲或螢火蟲視頻直播平臺服務制作、上載、傳播包含如下任何內容的信息：
7. Users shall not use fireflies or fireflies video live platform services to produce, upload and disseminate information containing any of the following:
(1)反對憲法所確定的基本原則的；
(1) Those who oppose the basic principles established by the Constitution;
(2)危害國家安全，泄露國家秘密，顛覆國家政權，破壞國家統壹的；
2) endangering national security, leaking national secrets, overthrowing national power and undermining national unity;
(3)損害國家榮譽和利益的；
(3) to the detriment of the country's honour and interests;
(4)煽動民族仇恨、民族歧視，破壞民族團結的；
(4) Incitement to national hatred, ethnic discrimination and destruction of national unity;
(5)破壞國家宗教政策，宣揚邪教和封建迷信的；
(5) Those who undermine the State's religious policy, preach cults and feudal superstitions;
(6)散布謠言，擾亂社會秩序，破壞社會穩定的；
(6) To spread rumours that disturb social order and destabilize society;
(7)散布淫穢、色情、賭博、暴力、兇殺、恐怖或者教唆犯罪的；
(7) Propaganda, pornography, gambling, violence, murder, terror or incitement to commit a crime;
(8)侮辱或者誹謗他人，侵害他人合法權益的；
(8) insults or insults others or infringes on the legitimate rights of others;
(9)含有法律、行政法規禁止的其他內容的信息。
(9) Information containing other elements prohibited by law, administrative rules and regulations.
8、根據合理判斷，螢火蟲可以對違反法律法規、本《協議》約定，侵犯、妨害、威脅他人權利的內容，或者假冒他人名義發布的內容，依法采取停止傳輸、下線等措施，並有權依合理判斷對違反本條款的用戶采取適當的法律行動，包括但不限於：從螢火蟲服務平臺中保全具有違法性、侵權性、不當性等內容、限制或禁止用戶使用螢火蟲全部或部分服務、註銷用戶帳戶以及依據法律法規保存有關信息並向有關部門報告等。
On the basis of a reasonable judgement, fireflies may take measures to stop transmissions, de-links, etc. against content that violates the laws, the terms of this Agreement, violates, impairs or threatens the rights of others, or falsely disseminates content, and have the right to take appropriate legal action against users of this provision on the basis of a reasonable judgement, including, but not limited to, the preservation from fireflies service stand of such elements as illegality, abuse, impropriety, restriction or prohibition of the use of fireflies in all or part of their services, cancellation of user accounts and the preservation of relevant information and reporting to the relevant ministry, in accordance with the provisions of the law.
9、用戶權利及義務：
9. Users'rights and obligations:
(1)螢火蟲帳號的所有權歸螢火蟲所有，用戶完成申請註冊手續後，獲得螢火蟲帳號的使用權，該使用權僅屬於初始申請註冊人，禁止用戶贈與、借用、租用、轉讓或售賣螢火蟲帳號。如果使用者並非帳號初始申請註冊人，螢火蟲有權在未經通知的情況下凍結、回收該帳號而無需向該帳號使用人承擔法律責任，由此導致的包括並不限於用戶通訊中斷、用戶資料和虛擬道具等清空等損失由用戶自行承擔。若帳號的歸屬出現爭議的，螢火蟲官方在收到相關方的投訴後，有權暫時凍結該爭議帳號；爭議各方在舉證期（7個工作日）內提供證據證明帳號歸屬，螢火蟲官方依據各方提供的證據判斷歸屬後，解凍爭議帳號。
(1) If the user does not initially request a fireflies account, the fireflies have the right to freeze in unnotified circumstances, to recover the account without having to assume legal responsibility for the user of the account, resulting in losses that are not limited to the clearing of the user’s user’s account, such as the break-up of the user’s account, the user’s user’s user’s account, the rent, lease, transfer, or sale of the fireflies account. If the user does not initially request a fireflies account, the fireflies have the right to freeze the fireflies in unnotified circumstances, and to recover the account without having to assume legal responsibility for the user’s registration, and the resulting loss is not limited to clearing the user’s communication, user’s data, and virtual propriety of the user’s account. If there is a dispute over the account, the fireflies official has the right to suspend the dispute, after receiving a complaint from the party; the parties have provided evidence during the filing (7 working days) that the account is attributable to the fireflies’s official decision on the evidence provided by the parties.
(2)用戶可以更改、刪除在螢火蟲帳號或平臺上的個人資料、註冊信息及傳送內容等（但用戶不可自行註銷螢火蟲帳號）。用戶在更改、刪除有關信息的同時也可能會造成儲存在系統中的文字、圖片、視頻等丟失，螢火蟲對用戶自主操作導致內容丟失不承擔責任。請註意，手機號或微信號壹經與螢火蟲帳號綁定，無法解除綁定。
(2) Users can change, delete personal data, register information, and send content on fireflies accounts or platforms (but the user is not free to cancel fireflies accounts). The user may also cause loss of text, images, videos, etc. stored in the system when changing or deleting the information. Fireflies lose responsibility for content when they operate autonomously. Please note that mobile phones or micromails are tied to fireflies accounts and cannot be removed.
(3)用戶有責任妥善保管註冊帳號信息及帳號密碼的安全，用戶需要對註冊帳號下的行為承擔法律責任。由於帳號、密碼等信息外借、泄露或者被他人盜用而引起的法律責任，由註冊用戶自行承擔。用戶同意在任何情況下不使用其他用戶的帳號。
(3) The user is responsible for the security of the registered account information and the password of the account, and the user is legally liable for the actions of the registered account. The legal liability arising from the loan, disclosure or theft of information from the account, password, etc., is borne by the registered user. The user agrees not to use the account of the other user in any case.
(4)用戶應遵守本協議的各項條款，正確、適當地使用本服務，不得擾亂平臺秩序，包括但不限於擾亂平臺金融秩序（如出售鉆石、映幣等）。如用戶違反本協議或其他平臺規則的任何條款，螢火蟲有權依據協議終止/暫停對違約用戶螢火蟲帳號提供全部或部分服務。若帳號任何功能被終止/中止的，無法參加任何官方活動。若賬號被永久封禁的，賬號內的鉆石和映幣將被全部清空，不予取現。
(4) Users shall comply with the provisions of this Agreement and use this service correctly and appropriately, without disturbing the order of the platform, including but not limited to the financial order of the platform (e.g., the sale of diamonds, funds, etc.). If the user violates any of the provisions of this Agreement or other rules of the table, the fireflies shall have the right to terminate/suspend all or part of their services to the fireflies account under the agreement. If any function of the account is terminated/discontinued, they will not be able to participate in any official activity. If the account is permanently blocked, the diamonds and money in the account will be completely emptied and withheld.
(5)用戶保證註冊螢火蟲帳號時提供的信息真實、完整。因信息非法、不真實、不準確等所產生的法律責任由用戶承擔。用戶註冊信息發生變更的，應及時更新註冊資料，滿足及時、詳盡、真實、準確的要求。
(5) The user guarantees that the information provided on the registered fireflies account is true and complete. The legal responsibility arising from the illegal, untrue, and inaccurate information is borne by the user.
(6)用戶可以在使用螢火蟲服務過程中購買鉆石、映幣等虛擬道具增值服務。除法律規定的情形外，用戶購買虛擬道具之後，螢火蟲不提供退、換或兌現成人民幣或其他任何貨幣的服務。
(6) Users can purchase virtual prop value-added services such as diamonds and film money in the process of using fireflies.
(7)用戶註冊螢火蟲帳號後，連續3個月不登錄使用的，螢火蟲有權註銷該帳號，以免造成資源浪費，由此帶來損失均由用戶自行承擔。
(7) The fireflies account is not registered for three months in a row, and the fireflies have the right to declare the account in order to avoid waste of resources, resulting in losses that are borne by the users themselves.
(8)用戶同意授予螢火蟲無償使用通過螢火蟲平臺發布的或用戶使用螢火蟲服務過程中形成的信息、內容等，螢火蟲可以通過包括改編、匯編、復制、發行、網絡傳播在內的壹切方式進行使用。如果用戶不同意螢火蟲使用相關內容，應事先通過書面方式告知螢火蟲。
(8) Users agree to grant fireflies free access to information, content, etc. generated through fireflies stand distribution or user use of fireflies services. Fireflies can be used in any way that includes editing, editing, copying, distribution, Internet distribution. If users do not agree to fireflies using relevant content, fireflies should be informed in writing in advance.
(9)用戶在使用螢火蟲提供的服務過程中，若發現涉政、涉槍、涉毒、涉暴、賭博、涉黃的內容，可以向螢火蟲工作人員舉報、投訴。螢火蟲在收到舉報、投訴後，將派專員及時處理。
(9) In the process of using the services provided by fireflies, users can report and file complaints to fireflies workers if they find anything related to politics, guns, drugs, violence, gambling, or yellow.
(10)您不得利用螢火蟲進行任何形式的洗錢活動。螢火蟲將嚴密監控此類行為，並有權對多個定向賬戶中異常的、數額較大的虛擬資產流轉進行調查，並有權配合主管機關的調查提交您的身份資料、有關賬戶的交易記錄等信息。
(10) You are not allowed to use fireflies for any kind of money-laundering activity. Fireflies will closely monitor such actions and have the right to investigate unusual, larger, virtual flows of assets in multiple targeted accounts, and to submit information about your identity, records of transactions with accounts, etc., in cooperation with the competent authorities.
用戶知悉並同意：個人隱私信息是指能夠對用戶進行個人辨識或涉及個人通信的信息，包括用戶真實姓名、身份證號、手機號碼、銀行賬戶、IP地址等。非個人隱私信息是指用戶對本服務的操作狀態以及使用習慣等壹些明確且客觀反映在螢火蟲服務器端的基本記錄信息和其他壹切個人隱私信息範圍外的普通信息，以及用戶同意公開的上述隱私信息。
Users know and agree that personal privacy information refers to information that enables personal identification of users or that involves personal communication, including the user’s real name, identification number, cell number, bank account, IP address, etc. Non-personal privacy information refers to the user’s operational status of the service and the use of basic record information that is clearly and objectively reflected on the fireflies server and other information that is common to all personal privacy information, as well as the privacy information that the user agrees to make public.
螢火蟲尊重用戶個人隱私信息的私有性，螢火蟲將會采取合理的措施保護用戶的個人隱私信息，除法律或有法律賦予權限的政府部門要求或用戶同意等原因外，螢火蟲未經用戶同意不向除合作單位以外的第三方公開、透露用戶個人隱私信息。
Fireflies respect the privacy of the user's personal privacy information, and fireflies will take reasonable measures to protect the user's personal privacy, except for reasons such as legal or authorized government departments requiring or consent of the user, where the fireflies do not consent to the disclosure of personal privacy information to a third party other than the cooperating unit.
用戶在註冊時選擇同意，或用戶與螢火蟲及合作單位之間就用戶個人隱私信息公開或使用另有約定的除外，用戶應自行承擔因此可能產生的任何風險，螢火蟲對此不承擔責任。
The fireflies are not liable for any risks that may arise if the user chooses to consent at the time of registration, or if there is an agreement between the user and the fireflies and cooperating units to make personal information of the user publicly available or otherwise contracted.
為了運營和改善螢火蟲的技術和服務，便於螢火蟲向用戶提供更好的用戶體驗和提高螢火蟲的服務質量，螢火蟲將可能會自行收集使用或向第三方提供用戶的非個人隱私信息，具體請仔細閱讀協議下方的《螢火蟲用戶隱私政策》。
To operate and improve fireflies technology and services, fireflies provide users with better user experience and improved service quality. Fireflies may collect non-personal privacy information for their own use or to third parties. Read more about the Fireflies privacy policy under the agreement.
螢火蟲服務中所涉及的螢火蟲圖形、文字或其組成，以及其他螢火蟲標誌及產品、服務名稱，均為螢火蟲之商業標識（以下簡稱“螢火蟲標識”）。未經螢火蟲事先書面同意，用戶不得將螢火蟲標識以任何方式展示、使用或申請註冊商標、進行域名註冊等，也不得實施向他人明示或暗示有權展示、使用、或其他有權處理螢火蟲標識的行為。用戶由於非法使用螢火蟲標識給螢火蟲或他人造成損失的，由用戶承擔相關法律責任。
Fireflies, text or its composition, and other fireflies signs and products, service names are commercial brands of fireflies (hereinafter referred to as " fireflies"). Without prior written consent of fireflies, users may not display, use, or request registration of fireflies in any way, or register their domain names, or perform behaviour that explicitly or implicitly entitles others to display, use, or otherwise handle fireflies.
1、平臺的服務包括螢火蟲運營的網站、網頁應用、軟件以及內含的文字、圖片、視頻、音頻等元素，螢火蟲對其服務標誌、標識以及上述任何元素享有全部知識產權。
1. The platform's services include websites, web applications, software and elements of text, pictures, videos, audio, etc., where fireflies have full knowledge of their service signs, labels and any of the above elements.
2、用戶在平臺提供直播服務期間產生的任何成果（包括但不限於直播視頻、音頻，以下統稱“主播成果”）的知識產權由用戶享有。 您同意許可螢火蟲在全世界範圍內永久性地、不可撤銷地、獨家地使用和可再許可及（或）轉授權任意第三方使用主播成果，包括但不限於復制權、發行權、出租權、展覽權、表演權、放映權、廣播權、信息網絡傳播權、攝制權、改編權、翻譯權、匯編權以及《著作權法》規定的由著作權人享有的其他著作財產權利，螢火蟲無須對此額外向用戶支付任何費用。
2. The user has the right of intellectual property over the duration of the live broadcasting service (including, but not limited to, live video, audio, or what is commonly referred to as “broadcast results”). You agree to allow fireflies to be used by third parties on a permanent, irrevocable, exclusive and re-licensed and/or re-licensed basis throughout the world, including, but not limited to, copy rights, issue rights, rental rights, exhibition rights, performance rights, screening rights, broadcasting rights, information network broadcasting rights, recording rights, reformation rights, translation rights, copying rights, and other copyright rights for copyright holders under the Copyright Act.
3、任何第三方未經螢火蟲同意，不得將用戶在平臺上的主播成果、所發表言論等進行復制、修改、編輯、轉讓、使用、通過信息網絡傳播或作其他用途，包括但不限於通過截取視頻信號、抓取錄播音頻／視頻、編輯視頻/音頻/文字和其他形式的內容等方式。否則，螢火蟲有權就任何主體侵權而以螢火蟲自己的名義單獨或委托第三方機構提起訴訟或開展其他法律行動，並獲得全部賠償。
3. No third party may reproduce, modify, edit, transfer, use, disseminate through the information network or use the user without the consent of the fireflies on the platform, etc., including, but not limited to, intercepting video signals, capturing audio/videos, editing video/broadcasts/text and other forms of content. Otherwise, the fireflies have the right to sue or open other legal action against the fireflies themselves or to commission a third-party body for abuse of their rights.
1、用戶違反本《協議》或相關服務條款的約定，導致第三方向螢火蟲及其合作公司、關聯公司提出索賠等要求的，用戶同意承擔全部法律責任，包括但不限於賠償金、罰金、和解費、訴訟仲裁費、合理的律師費支出等，並同意賠償因此給螢火蟲造成的損害
1. If the user violates the terms of this Agreement or the relevant service provisions, resulting in a request by a third party to claim compensation from the fireflies and their cooperating companies, related companies, etc., the user agrees to assume full legal responsibility, including but not limited to compensation, fines, settlement fees, arbitration fees, reasonable legal fees, etc., and agrees to compensate for damage caused to the fireflies as a result.
2、用戶因第三方如電信部門的通訊線路故障、技術問題、網絡、電腦故障、系統不穩定性及其他各種不可抗力原因而遭受的壹切損失，螢火蟲及其合作單位不承擔責任。
2. The fireflies and their cooperating units are not responsible for all the damage suffered by users as a result of third parties, such as communications circuit malfunctions, technical problems, networks, computer malfunctions, system instability and other forms of force majeure.
3、因技術故障等不可抗事件影響到服務的正常運行的，螢火蟲及其合作單位承諾在第壹時間內與相關單位配合，及時處理進行修復，但用戶因此而遭受的壹切損失，螢火蟲及其合作單位不承擔責任。
3. If a non-resistible event, such as a technical failure, affects the proper operation of the service, the fireflies and their collaborating units undertake to work with the relevant units within the first hour and to process and repair them in a timely manner, but the user suffers from any damage and the fireflies and their collaborating units are not liable.
4、用戶理解：本服務同其他互聯網服務壹樣，用戶在使用服務過程中會受到網絡服務質量、社會環境、用戶操作錯誤等諸多因素的影響，可能會受到各種問題的侵擾，比如他人利用用戶的資料，進行現實生活中的騷擾。用戶下載安裝的其它軟件或訪問的其他網站中含有“特洛伊木馬”等病毒，威脅到用戶的計算機信息和數據的安全，繼而影響本服務的正常使用等等。用戶應加強對信息安全及使用者資料的保護意識，以免遭受損失和騷擾，因使用螢火蟲服務的風險由用戶自行承擔。
Users understand that this service, like other Internet services, is subject to a variety of factors, such as the quality of Internet services, the social environment, user error, etc., in its use, and may be subject to various problems, such as physical harassment by others using user data. Users downloading other software installed or visiting other websites contains viruses such as “Tloimma” that threaten the security of users' computer information and data, and subsequently affect the normal use of their services. Users should increase their awareness of information security and user data so as to avoid loss and harassment.
5、用戶理解：本服務涉及Internet服務，可能會受到各個環節不穩定因素的影響，本服務存在因不可抗力、計算機病毒或黑客攻擊、系統不穩定、用戶所在位置、用戶關機以及其他任何技術、互聯網絡、通信線路原因等造成的服務中斷或不能滿足用戶要求的風險。因前述情形導致用戶不能發送、接受、閱讀信息、或接發錯信息，螢火蟲不承擔任何責任。
Users understand that this service, which involves Internet services, may be affected by a combination of unstable factors, with service interruptions or failure to meet user requirements due to force majeure, computer viruses or hacker attacks, system instability, user location, user closures, and any other technology, interconnectivity, communication links, etc.
6、用戶理解：使用本服務過程中存在可能面對來自他人的包括但不限於威脅性的、誹謗性的、令人反感的或其他非法的內容或行為和/或侵犯他人權利（包括但不限於知識產權）的匿名或冒名的信息的風險，用戶須承擔以上風險。螢火蟲和其合作公司對視頻直播平臺服務不作任何明確或暗示的擔保，包括但不限於有關信息真實性、適商性、適於某壹特定用途、所有權和非侵權性的內容，對因此導致任何因用戶不正當或非法使用螢火蟲直播平臺服務產生的直接、間接、偶然、特殊及後續等侵犯第三人之合法權利的法律責任，螢火蟲不承擔任何責任。
6. Users understand that there is a risk in the course of using this service that anonymous or pseudonymic information, including, but not limited to, threatening, obscurantious, offensive or other illegal content or conduct and/or violation of the rights of others, including but not limited to intellectual property rights, may be exposed to such risks.
